Telephoned VOSA today and they confirmed that if you have a headlight you do not need a front position light.

Motorcycles with headlamps don't need a front position lamp for MOT purposes- irrespective of original fitment.
Go back to the VTS and ask the tester to check the manual. The correct result should be a pass

Many thanks for your help and sorry if I sounded a bit off, I have also e-mailed VOSA to see if they can clarify so will post the result.
Hopefully my interpretation of it will be right as having to have sidelights (that no one uses) on a bike is a bit silly and not forgetting that 99% ride with their dipped lights on anyway.

OE is original equipment, C&U is Construction and Use? Police issue. Do you have a sidecar attached?
I think the information you have is either incorrect or deceiving, not having "The Manual" to hand, I will check it out tomorrow and get back to you.

Not wanting to get into a discussion about how to install the sidelight the question I am trying to ask (and have probably not articulated it properly) is whether or not I need to install a position light/sidelight as the MOT manual states:
A motor bicycle (with or without a side car) fitted with a headlamp need not have a front position lamp (but must have one on the side car, if a side car is fitted).
Or because I have the switch for it the bike would fail because one is not fitted?
Hopefully this has cleared it up and thanks for the help.

surely you would have to turn the switch in the stated order through the positon lamp setting to get to dip/main beam?
as stated by you it was an original equipment fitting and C&U requirement.

Yeah cheers for that one, the question was whether I should have to or whether it was a case of the tester not looking at the manual correctly or me misinterpreting it. Having near enough re-wired the bike it would be alot easier if I didnt have to fit another light that I would never use.

| so fit a front position lamp then, not rocket science, and obviosly an OE fitment.

Hey all, I need some help/advice. My 1984 CBX 750 has just failed it's MOT!
The story is that I brought it off ebay £150 and totally stripped it naked and fitted a new headlight with high beam or dipped beam. The switch on the motorbike has 3 settings, off, parking (sidelights) and main. When in the parking mode the rear brake light is on (nothing at the front).
The tester has said that the bike failed because the front position light does not work however in the MOT manual it states :-
A motor bicycle (with or without a side car) fitted with a headlamp need not have a front position lamp (but must have one on the side car, if a side car is fitted).
Does this mean that I should have passed?
If anyone can spread any light on this (excuse the pun!) I would be really gratefull.
